Cutler Bay presents a unique set of architectural and regulatory challenges that make local knowledge essential before a single drawing is made. The town sits in close proximity to Biscayne Bay and the Atlantic Ocean, making it vulnerable to three distinct flood sources — tidal flooding and storm surge from hurricanes, flash flooding from heavy rainfall, and riverine flooding from canal and drainage system overflows.

 

The town's floodplain ordinance requires all new construction and substantially improved buildings to be built to a finished floor elevation of one foot above the base flood elevation established by FEMA. And Cutler Bay's 44% rule means that if a structure is improved or damaged beyond 44% of its market value, it must fully comply with current elevation and floodplain requirements. A rule that catches many homeowners off guard mid-renovation.

 

The Town of Cutler Bay also requires submission of recent property boundary surveys as part of every building permit application, and topographic surveys prior to permit closeout; adding a layer of documentation that must be coordinated early in the design process.
